01Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Freaking Amazing Marketing, LLC ("FAM," "we," "us," or "our"). They apply when you visit this website, book a call, sign up for our communications, buy from us, or use our services and platforms.

By using our website or services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use them. You must be at least 18 years old, or the age of majority where you live, to hire us or buy from us.

02Our services

FAM provides custom website design and development, lead funnels, CRM and automation setup, SEO, content systems, hosting, coaching, and access to tools in our Drop Suite.

The scope, timeline, price, and deliverables for any project are set out in your proposal, invoice, or signed agreement. If anything in that project agreement conflicts with these Terms, the project agreement controls for that project.

03Using our website

You agree not to:

• Use the site for anything unlawful, fraudulent, or harmful.
• Copy, scrape, resell, or republish our content, designs, or portfolio without written permission.
• Try to gain unauthorized access to our systems, interfere with the site, or upload malicious code.
• Submit false information or impersonate anyone.

We may update, change, or remove any part of the website at any time.

04Quotes, bookings, and payments

• Quotes are based on the scope discussed and are valid for the period stated on the quote.
• Work begins once we receive your signed agreement, where applicable, and any required deposit.
• Payments are due on the schedule in your invoice or agreement. Recurring plans, such as hosting and monthly support, renew automatically until canceled as described in your plan.
• We may pause work, or pause hosting, on accounts that are past due.
• Refunds, cancellations, and delivery are governed by our Fulfillment Policy and your project agreement.

Payments are processed by third-party payment processors, and your payment information is subject to their terms.

05Your content and responsibilities

You are responsible for the text, images, logos, music, videos, and other materials you give us ("Your Content"). You confirm that you own Your Content or have permission to use it, and that it does not violate anyone's rights or any law. You give us permission to use Your Content to perform our services.

Timely feedback, approvals, and access to accounts help us deliver on schedule. Delays in receiving what we need may move project timelines.

06Ownership and intellectual property

Everything on this website, including our designs, text, graphics, logos, and the FAM, DemoDrop, and Drop Suite names, belongs to FAM or our licensors.

For client projects, once your project is paid in full, you own your domain, Your Content, and the final website design created for you. FAM keeps ownership of its pre-existing tools, code libraries, templates, platforms, and know-how, and grants you a license to use them as part of your website.

Unless you ask us in writing not to, we may show your finished project in our portfolio and marketing.

07Hosting and the Drop Suite

Many client sites are hosted on DemoDrop, our web platform. We work hard to keep sites fast, secure, and online, but we cannot promise uninterrupted service. Maintenance, provider outages, or events outside our control may cause downtime.

You may move your website off our platform at any time. Accounts used for unlawful content, spam, or abuse may be suspended. Access to any Drop Suite product may also be subject to that product's own terms.

08Text messaging terms

By giving us your mobile number and opting in, you agree to receive text messages from Freaking Amazing Marketing at that number, which may include appointment reminders, project and account updates, customer care, and, if you choose, marketing messages. Messages may be sent using automated technology.

We will not share your mobile number or opt-in information with third parties or affiliates for their marketing purposes. See our Privacy Policy for details.

09Third-party services

Our work often connects to tools we do not own, such as domain registrars, CRM and scheduling platforms, payment processors, email providers, social media, and ad platforms. Your use of those tools is subject to their terms and fees, and we are not responsible for their changes, outages, or policies.

10No guaranteed results

We bring strategy, creative, and proven systems to every project, but results such as search rankings, traffic, leads, sales, or revenue depend on many factors outside our control. We do not guarantee any specific outcome.

Our website and services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11Limitation of liability

To the fullest extent allowed by law, FAM and its owners, team members, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim related to our website or services is limited to the amount you paid us for the specific service giving rise to the claim during the twelve months before the claim arose.

12Indemnification

You agree to defend and hold harmless FAM and its owners, team members, and contractors from claims, losses, and expenses, including reasonable attorneys' fees, arising from Your Content, your use of our website or services, or your violation of these Terms or anyone else's rights.

13Termination

Either party may end a project or ongoing plan as described in the project agreement. We may suspend or end access to our website, platforms, or services if these Terms are violated. Sections that by their nature should continue, such as ownership, payment obligations, disclaimers, limitation of liability, and indemnification, survive termination.

14Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. We would always rather work things out together, so please contact us first. If a dispute cannot be resolved informally, it will be brought in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver.

15Changes to these terms

We may update these Terms from time to time. The effective date at the top shows when they last changed. Continuing to use our website or services after an update means you accept the updated Terms.
